Mobile Terms of Service

These Mobile Terms of Service (the "Mobile Terms") govern the Wairua Beauty text messaging program (the "Program") operated by Wairua Beauty ("Wairua," "we," "us," or "our"), 1220 17th Street, Suite 101, Miami Beach, FL 33139. By opting in to the Program you agree to these Mobile Terms, our Terms of Service and our Privacy Policy.

1. Program description

When you opt in to the Program, we may send you recurring automated marketing and promotional text messages (SMS and MMS) at the mobile number you provided. These messages may include special offers and promotions, new treatments and products, membership and rewards updates, appointment availability and booking reminders, event invitations, and reminders about items or bookings you left incomplete on our website. Messages may be sent using an automatic telephone dialing system or other automated technology. Message frequency varies.

2. Consent is voluntary

Your consent to receive marketing text messages is not a condition of any purchase or of booking any service with Wairua Beauty. You may opt in by submitting your mobile number through a sign-up form on our website, by texting a keyword to our number, at checkout, or through any other method we make available. By opting in you confirm that you are the account holder for the mobile number provided, or that you have the account holder's permission, and you authorize us to send messages to that number even if it is registered on a federal or state Do Not Call list.

3. Eligibility

You must be 18 years of age or older and located in the United States to participate in the Program.

4. Message and data rates

Message and data rates may apply. Wairua Beauty does not charge for the Program, but you are responsible for any charges from your wireless carrier for the messages you send and receive. Check with your carrier for details about your plan.

5. How to opt out

You can cancel the Program at any time by texting STOP to the number from which you receive our messages. After you send STOP, we will send you a one-time confirmation message to acknowledge your opt-out, and you will no longer receive marketing text messages from us. You may also opt out by following the unsubscribe instructions included in our messages or by contacting us at info@wairuabeauty.com. If you would like to rejoin, sign up again as you did the first time. Opting out of the Program does not affect non-marketing messages you have separately requested, such as appointment confirmations and reminders sent by our booking system.

7. Carrier disclosure

The Program is available on major U.S. wireless carriers, including AT&T, T-Mobile and Verizon Wireless. Carriers are not liable for delayed or undelivered messages. Delivery of messages is subject to effective transmission from your wireless carrier and network operator and is not guaranteed.

8. Changes to your mobile number

If you change, deactivate or transfer your mobile number, you agree to opt out of the Program or notify us before doing so, so that messages are not sent to a number that may be reassigned to someone else. You are responsible for any messages sent to a number that is no longer yours if you have not notified us.

9. Privacy

We respect your privacy. The mobile number you provide and your consent to receive text messages are used only to operate the Program. We will not share or sell your text message opt-in data or consent status with any third party, affiliate or partner for their own marketing or promotional purposes. This information is shared only with the service providers that help us deliver messages, such as our messaging platform provider and wireless carriers, and only for that purpose. Please review our Privacy Policy for details on how we collect, use and protect your information.

10. Changes to the Program and these Mobile Terms

We may change, suspend or end the Program, change the number from which messages are sent, or update these Mobile Terms at any time. The current version will be posted on this page with an updated "Last updated" date, and your continued participation in the Program after a change constitutes acceptance of the revised Mobile Terms. If we change the number used for the Program, STOP or HELP requests sent to the former number may not be received, so please use the number from which you most recently received a message.

11. General

These Mobile Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles. The disclaimers, limitations of liability and other provisions of our Terms of Service apply to the Program. If any provision of these Mobile Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
